Introduction

These Terms of Use ('Terms') govern your use of our website and services ('Services'). As some of our Services may be software that is downloaded to your computer, phone, tablet, or other device, you agree that we may automatically update this software, and that these Terms will apply to such updates.     • Comply with these Terms, all applicable laws, and our policies (including any other policies that may be applicable from time to time (“Policies”));
    • Are over the age at which you can provide consent to data processing under the laws of your country.

    Any violation of our Terms, applicable laws, or Policies may result in your access to all or part of the Services being suspended, disabled, or terminated. When you create your Daily Learning; account, and when you subsequently use certain features, you must provide us with accurate and complete information, and you agree to update your information to keep it accurate and complete.

    Our License to You

    Subject to these Terms and our Policies, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license right to use our Services. The rights granted herein are only for your personal, non-commercial use, unless you obtain our written permission otherwise. You also agree that you will create, access, and/or use only one user account, unless expressly permitted by Daily Learning; and you will not share access to your account or access information for your account with any third party. Using our Services does not give you ownership of or any intellectual property rights in our Services or the content you access.

      Commercial Use

      Any use of our Services for commercial purposes is strictly prohibited. Any commercial use must be subject to a separate agreement with Daily Learning.

        Content Offerings

        The Site provides access to lessons, exercises, answers, quizzes and other types of teaching aids. All of this information is published on the Site for information purposes only and to assist in understanding school curricula. The information is in no way intended to be a substitute for official school curricula. Consequently, you acknowledge that Daily Learning cannot be held liable for the information offered on the Site and you accept that the use of this information is carried out under your sole and entire responsibility, control and direction.

          Guarantees and responsibilities

          The content of the Site has been compiled with the utmost care by education professionals and is carefully checked by experts who do their utmost to ensure that the information accessible on the Site is accurate and regularly updated. However, Daily Learning does not provide any express or tacit guarantee concerning all or part of the Site and is not responsible for the topicality, accuracy, exhaustiveness or quality of the information disseminated on the Site. Under no circumstances shall Daily Learning be held liable for any direct or indirect material or immaterial damage, whatever the cause, origin, nature or consequences, arising from the consultation and/or use of the Website. In addition, Daily Learning declines all responsibility in the event of interruption or inaccessibility of the Site, the occurrence of bugs or any damage resulting from fraudulent acts (such as intrusions) by third parties from the Site. Daily Learning takes steps to ensure the confidentiality and security of personal information collected on the Website. However, it does not control the risks associated with the operation of the Internet and draws your attention to the existence of possible risks in terms of confidentiality of data transiting via this network.

            Intellectual property rights

            Daily Learning is the owner of the domain name Dailylearn.org (and its variations). The associated Site is an intellectual work protected by intellectual property law. The Site as a whole and each of the elements that make it up (such as texts, courses, exercises, statements, answers, methods, tips, tree structures, software, animations, images, drawings and models, trademarks, photographs, illustrations, diagrams, logos, sounds, music, and all downloadable elements, etc.) are, unless otherwise stated, the exclusive property of Daily Learning, which alone is entitled to use the related intellectual property rights. Consequently, the reproduction, representation and alteration of all or part of the Site on any medium, for any use other than personal and private, for non-commercial purposes, are strictly prohibited, unless expressly authorised in advance by Daily Learning. Violation of these provisions is punishable by penalties in accordance with the provisions of the Intellectual Property and Criminal Codes, particularly with regard to copyright and trademark infringement, as well as the Civil Code with regard to civil liability. If, however, the content of the Site should infringe the intellectual property rights of third parties, Daily Learning undertakes to remove the subject of the dispute from its publication immediately, after having been informed of the infringement, and/or to make known the true author or owner of the rights.

              Sponsorship and Advertising

              As a non-profit Organization, Daily Learning relies on our sponsors, donors, and other contributors to provide funding necessary to provide the free Service to our users. From time to time, we permit third parties to sponsor content displayed on our Service. For example, for-profit organizations may wish to sponsor all content related to a particular educational topic, such as astronomy or biology. Daily Learning does not share any of your personal information with these sponsors without your consent. We do not provide these sponsors with the ability to track or collect information about our site visitors or users. Daily Learning does not display third party advertisements on our Service. We may, from time to time, incorporate content or link to content provided by third parties that may be of interest to you and relevant to the educational context of our Service. Some of these materials or websites may include branding or advertisements as permitted by the third party owner or operator. For more information, please review Links to third parties. Please note that we use our best efforts and take multiple steps to avoid the collection of information for targeted advertising purposes when we believe the Service is being used by Students or Children. For example, we take steps to inhibit third party advertising networks from collecting information for targeted advertising purposes on webpages with child-directed content or when a Student or Child User logs into the Service. Daily Learning uses the available privacy functionality in YouTube to display video content on YouTube (see additional information under “Learn More”).

                Modification of these general conditions of use

                Daily Learning expressly reserves the right to modify these General Conditions of Use, with the exception of clauses relating to duration and characteristics, at any time and without prior notice. These modifications are published online and are deemed to have been accepted without reservation when you access the Site after they have been published online. Daily Learning also reserves the right to modify, add to or delete all or part of the content of the Site or the offer it makes on it without notice, either temporarily or permanently. We therefore recommend that you consult this section regularly.

                  Disputes

                  These General Terms and Conditions of Use have been drawn up in accordance with Cameroonian law. Cameroonian courts have territorial jurisdiction to hear any dispute relating to the Site, without prejudice to your right, if you are a user, to bring proceedings before the competent courts of another city, in accordance with the laws defining users' rights.

Some of our Site’s functionality can be used without revealing any Personal Data, but for features or Services related to the Content Offerings, Personal Data is required. In order to access certain features and benefits on our Site, you may need to submit, or we may collect, "Personal Data" (i.e., information that can be used to identify you and which may also be referred to as “personally identifiable information” or “personal information”). Personal Data can include information such as your name, email address, IP address, and device identifier, among other things. Daily Learning is also likely to collect your personal data when you request it via the "contact" section in order to answer any questions you may have. The personal data collected may concern minors. This data is strictly necessary for the provision of the service and will only be processed by Daily Learning with the prior consent of the parents. When you provide personal data, you undertake to communicate accurate information that is not prejudicial to the interests and/or rights of third parties. The information and data collected about you are processed by Daily Learning for the purpose of (i) providing you with a personalised service, (ii) managing your requests, (iii) producing statistical analyses, (iv) offering you personalised advertising and marketing content where appropriate. The provision of this information and data is necessary to offer you the services to which you wish to have access. If you do not provide your personal data, your request to create an account cannot be processed. In connection with the above purposes, your data may be transmitted to service providers responsible for managing, executing and processing payment transactions (in particular donations). This data is processed and stored by the Site host identified in the legal notice on the Site under conditions designed to ensure its security. In any event, all of the Company's subcontractors provide sufficient guarantees to ensure the protection of your data. When you create an account, your data is stored for the period necessary for the performance of the services you wish to access and up to 3 years after the end of the service or 03 years from the last contact between you and Daily Learning, whichever is the longer. As part of your use of the services, we may provide you with content tailored to your profile based on the results obtained. This personalisation is necessary for the provision of our services as it enables us to offer you the school programme best suited to your needs and to enable you to progress at your own pace. Daily Learning undertakes to take all the technical and organisational security measures necessary to preserve the confidentiality and security of your data. If you agree (for example when creating your account to register for the Service), you may receive commercial offers from our partners at the e-mail address you have provided and your details may be passed on to these commercial partners. Under no circumstances will we disclose your personal information to third parties for their marketing and advertising purposes without your express prior consent. If you no longer wish to receive this content, you may notify us at any time by clicking on the link provided at the bottom of each content item. In accordance with Law No. 2010/012 of 21 December 2010 on cybersecurity and cybercrime in Cameroon and its implementing decrees, you have the right to access, rectify, delete, object to, limit the processing of and port your personal data. You may exercise your rights as described below at any time by contacting our customer support.

                          If you wish to exercise your right of access, we will provide you with the following information in particular:

                          • If the data is no longer necessary for the purposes for which it was collected or is being processed;
                          • If you have withdrawn your consent to the processing of your data where prior consent is the legal basis for its collection and processing and there is no other legal basis for it;
                          • If you have exercised your right to object;
                          • If the processing of your personal data is unlawful;
                          • If there is a legal obligation to do so;

                          Right to limit processing

                          You may request the restriction of the processing of your personal data in one of the following cases:

                          • For the time necessary to allow us to carry out checks in the event that you dispute the accuracy of your personal data;
                          • If the processing of your data is unlawful but you wish to request the restriction of the use of the data rather than its deletion;

                          • If you have exercised your right to object to processing, for the duration of verifications aimed at analysing whether our legitimate reasons prevail over yours.

For example, an assessment of your academic level based on your results on the Site cannot be considered as data provided by you.

You must not disclose it to any third party. Daily Learning reserves the right at any time to suspend any identification code or password if you fail to comply with any of the above provisions. If you know or suspect a third party has knowledge of your identification code or password, you must inform Daily Learning at our customer support.

Hypertext links to third-party websites are intended to facilitate navigation by Internet users. Daily Learning has no present or future control over the design, content, updating, truthfulness or accuracy of external sites accessible by hyperlink, nor over their offers, advertising and the links to which they refer.                                   Daily Learning may install cookies on your terminal. A cookie is a small text file deposited on your hard drive, the purpose of which is to collect information about the way in which you visit the Site.                                     Identity Verification

                                    For Services that require identity verification, we may use the Personal Data that we collect for verifying your identity, and for authenticating that submissions made on the Site were made by you. This service may be provided through a third-party identity verification vendor. Your photo identification document will be deleted after successful verification of your profile information.

                                    Communications with or from Daily Learning

                                    When you send us an email message or otherwise contact us, we may use the information provided by you to respond to your communication and/or as described in this Privacy Notice. We may also archive this information and/or use it for future communications with you where we are legally entitled to do so.
